1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the ConvergenceSoft website (convergencesoft.com) and any related content, features, or contact forms (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms.

If you engage ConvergenceSoft for software engineering services, a separate Master Services Agreement (MSA), Statement of Work (SOW), or project contract will govern that engagement and take precedence over these Terms where they conflict.

2. About ConvergenceSoft

ConvergenceSoft is a software engineering agency providing SaaS product development, platform modernization, design systems, cloud infrastructure, and related technical services to businesses and product teams.

3. Use of the website

You agree to use the Site only for lawful purposes. You may not:

• Attempt to gain unauthorized access to our systems or data
• Interfere with or disrupt the Site's operation or security
• Scrape, crawl, or harvest data from the Site without permission

Project outcomes depend on scope, collaboration, third-party dependencies, and factors outside our control. Any timelines, metrics, or results referenced on the Site reflect past engagements and are not promises of future performance.

6. Contact form submissions

By submitting our contact form, you represent that the information you provide is accurate and that you have authority to share it. You agree to our Privacy Policy regarding how we process your submission.

Submitting an inquiry does not create a client relationship or obligate either party to enter into a contract. We reserve the right to decline engagements at our discretion.

7. Payments and billing

Fees for professional services are defined in your proposal, SOW, or contract. We may accept payment by bank transfer, invoice, or card through secure payment processors such as Stripe.

Cancellation, refunds, and billing disputes are governed by our Refund & Cancellation Policy, unless your signed agreement states otherwise.

8. Third-party links

The Site may contain links to third-party websites (including portfolio project URLs). We are not responsible for the content, privacy practices, or availability of those external sites. Accessing third-party links is at your own risk.

9. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONVERGENCESOFT AND ITS DIRECTORS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim related to the Site shall not exceed one hundred US dollars (USD $100) or the amount you paid us in the twelve months preceding the claim, whichever is greater.
